Interracial couple denied marriage license in Louisiana

NEW ORLEANS – A Louisiana justice of the peace said he refused to issue a marriage license to an interracial couple out of concern for any children the couple might have. Keith Bardwell, justice of the peace in Tangipahoa Parish, says it is his experience that most interracial marriages do not last long.

"I'm not a racist. I just don't believe in mixing the races that way," Bardwell told the Associated Press on Thursday. "I have piles and piles of black friends. They come to my home, I marry them, they use my bathroom. I treat them just like everyone else."

Bardwell said he asks everyone who calls about marriage if they are a mixed race couple. If they are, he does not marry them, he said.

Bardwell said he has discussed the topic with blacks and whites, along with witnessing some interracial marriages. He came to the conclusion that most of black society does not readily accept offspring of such relationships, and neither does white society, he said.

"There is a problem with both groups accepting a child from such a marriage," Bardwell said. "I think those children suffer and I won't help put them through it."

If he did an interracial marriage for one couple, he must do the same for all, he said.

"I try to treat everyone equally," he said.

Bardwell estimates that he has refused to marry about four couples during his career, all in the past 2 1/2 years.

Beth Humphrey, 30, and 32-year-old Terence McKay, both of Hammond, say they will consult the U.S. Justice Department about filing a discrimination complaint.

Humphrey, an account manager for a marketing firm, said she and McKay, a welder, just returned to Louisiana. She is white and he is black. She plans to enroll in the University of New Orleans to pursue a masters degree in minority politics.

"That was one thing that made this so unbelievable," she said. "It's not something you expect in this day and age."

Humphrey said she called Bardwell on Oct. 6 to inquire about getting a marriage license signed. She says Bardwell's wife told her that Bardwell will not sign marriage licenses for interracial couples. Bardwell suggested the couple go to another justice of the peace in the parish who agreed to marry them.

"We are looking forward to having children," Humphrey said. "And all our friends and co-workers have been very supportive. Except for this, we're typical happy newlyweds."

"It is really astonishing and disappointing to see this come up in 2009," said American Civil Liberties Union of Louisiana attorney Katie Schwartzmann. She said the Supreme Court ruled in 1967 "that the government cannot tell people who they can and cannot marry."

The ACLU sent a letter to the Louisiana Judiciary Committee, which oversees the state justices of the peace, asking them to investigate Bardwell and recommending "the most severe sanctions available, because such blatant bigotry poses a substantial threat of serious harm to the administration of justice."

"He knew he was breaking the law, but continued to do it," Schwartzmann said.

According to the clerk of court's office, application for a marriage license must be made three days before the ceremony because there is a 72-hour waiting period. The applicants are asked if they have previously been married. If so, they must show how the marriage ended, such as divorce.

Other than that, all they need is a birth certificate and Social Security card.

The license fee is $35, and the license must be signed by a Louisiana minister, justice of the peace or judge. The original is returned to the clerk's office.

"I've been a justice of the peace for 34 years and I don't think I've mistreated anybody," Bardwell said. "I've made some mistakes, but you have too. I didn't tell this couple they couldn't get married. I just told them I wouldn't do it."

Obama's Presidency & the Interracial Question

This is always a question that cums up for me as most of the girls I meet are white so everyone thinks that is what I like, which is true but I'm not xxxclusive. When I was growing up, I went to schools with only black, Asians, and Latinos. During college, I made white friends and they became the majority of my social circle. Also, the girls who seemed to share my interests were white, so naturally I spent more time with them.

I'm not saying a racial preference is good or bad, but that's my story.

I meant to post this...ummm....about three months ago. I found the comments after the story most interesting. It seems that the more things change, the more they stay the same.

I've always been disturbed by that familiar cop-out argument that people have used to express their opinion about interracial relationships. It seems to start with the disclaimer of, "I don't have anything against it," followed by, "but I worry for the children and how people will treat them." I find it an attempt to spare themselves of the responsibility of perpetuating negativity and seating it at the feet of "society". Something about that always made me want to ask them, "Then, why don't you do something about it when you witness it being done?"

Hi. I'm a caucasion (German/English/American) getting involved with a girl from South America. I came to find out that even in her own country she was dating white guys with blonde or light-colored eyes and hair.

She is brown-skinned/dark-eyed - a very normal hispanic appearance.

Her spoken ENglish is a little fuzzy sometimes, but her writing in English is almost superb, abnd rivals that of many Americans.

I wonder how and why she developed her interest in Caucasian men, and why "her own kind" does not seem to interest her very much. What is even more interesting to me is that she is slightly inexperienced in love for her age...yet she seems to know exactly what she likes, no question about it.

My landlady is also Hispanic, and she says that the men of my girlfriend's country are very undesireable.

Two older male relatives have warned me that truly Hispanic people always end up marrying their own kind in the end.

About the photo album!

Hello all,

I love that people have uploaded some cool photos to the public album. Usually, I don't check on the content much because the files have been pretty harmless. lately, I've noticed that some of the files are a bit more along a different direction than I'd image for the group.

I don't think anything is wrong with candid or racy photos that are provocative, but I draw a line on pics that appear to come from adult movie releases, pro or amateur. I say it while chuckling to myself, but apparently it must be said.

Please no pics of Chocolate, the Midnight Stripper. No photos of you and a loved one during coitus. You know where I'm going with this. It's not right. It's just not right! :)

More than I would ever have believed.

I have to tell this story because when I saw the group it reminded me of it!

How do you embrace their culture?

What are some ways you embrace your partner's culture and they embrace yours? Have you made any sacrafices in doing this? I think making an effort and sharing cultures shows love and commitment toward one another.

My partner is Belizean, so I show a lot of my lovin' through cooking all kinds of Creole foods in addition to spending a lot of time in Belize and with his family.

My partner has shown his commitment to embracing my culture by converting to Judaism...when we lived in Belize his whole family came over for Hanukah (since I was probably the only jew in belize) and they recited hebrew blessings and ate lots of Jewish food.

So the Bachelor is starting back up. I hate this show for the obvious reasons - crass slutty girls competing for someone they would never look at if he didn't have a lot of money. I have been wishing for a while that they would get a black NBA or NFL guy to do the show. Wouldn't that totally change the game? Personally i think that the powers that be are afraid of the possibility of an interracial couple falling in love (or whatever happens on so-called reality shows) in front of a national audience. Although we do have the FLAVOR of Love coming on now - but that is just a trainwreck

Ever feel like a dummy magnet?

So, I'm having a conversation with someone of another color (if you must know, yes, they were white) and they proclaim their hometown as "super liberal and progressive". I ask about the level of diversity and they say that it is basically 90% white and 10% divided amongst everyone else. Of course, I imagine that when there is so few of anyone else around, it's easy to talk the talk, although harder when it comes time to walk it. Must be the urban prince in me.

They continued spouting the virtues of their utopian hometown (and I'm beginning to wonder to myself, "Why are they here then?") when they say something about living in Heavenville (my name for their hometown) is great for the "ethnics"" because the "[they] haven't had a chance to isolate themselves yet".

I ask them to explain and the response soon spirals into oblivion with comments about Chinatown and xenophobia and blah blah blah. The entire time, I wondered if this person had an opportunity to view it from any other viewpoint other than a white one. Soon after, they bid me a hasty farewell and I noted that we'd have to continue the convo at another time.

Yeah, right. :)

It's always surprising to find people that think in such a me" kind of way. Does it happen much to anyone else? Am I missing something?

Interracism

My wife and I have been together over 20 years. I think we're fortunate to live in a place where there is very little racism. The type of racism that we've (or she) have had to deal with is very subtle, such as the waitress or store clerk that will somehow overlook you or the apartment that was available when you called 30 minutes earlier was somehow rented when you got there. Then of course there are the people that overcompensate by trying to be extra helpful and extra friendly. You know sometimes I think some people just want to be my wife's friend for the sake of having a black friend but shit whatever helps them get over it.
What are your expierence's?

HELLO FRIENDS I AM NEW TO THIS CIRCUIT! BUT I FEEL I HAVE SOMETHING TO CONTRIBUTE!!
Race? What race? Which race? What are we really! Arent we all human being? I believe very staunchly that we, humans, inhabiting different sectors of this planet which we call our home, which doesnt create any difference in the body parts and their functions, there is no difference in the composition of air we breath in, even the blood structure which run deep within us comprises of the same ingredients which the blood of the human in other part of the world, having the same group A A+ A-, B B+ B-, O O+ O-, AB+ etc. Its we who really create this racial differences not the nature which create us equal in all respects. It is not that an African, Indian, Japanese, Chinese, Russian, German or for that matter any one individual goes and resides in any of the countries besides his own he will be different in any way except for ethinical values. He will remain a human and thats all what should matter. Color is only skin deep, the color of a black man or an Indian or for that matter of any other person may differ apparently but the flesh is always red as the blood which coats it.
So why should there be racial difference, I wonder when will we understand and accept that the world is a beautiful place to live in, and we all are human beings first and then anything else.

Ok, I was born and raised in St. Louis until I was five years old and my mother moved us to SoCal to escape an abusive marriage.

My mom worked at the St. louis airport and some of her best friends were black. We lived in a neighborhood that was equally mixed black and white, I didn't even know that other cultures exisited until I move to Cali.

When I was three years old my favorite peice of clothing was my black knickers. But coming from a 3 year old its sounded like I was saying I want my black n*ggers.

My mom explained to me that I was never to say the n-word that it was a very hurtful word. And she helped me to pronounce knickers properly.

Moving to SoCal I grew up in a mostly white area, only had two black girlfriends in highschool, (the only two black girls in my highschool). When I was old enough to start going to clubs, I had friends who only dated black guys, not real good friends but ones I went out to the clubs with nontheless, who would make comments like there are some fine n*ggers in here tonight.

Once I started to go to Cal Poly in San Luis Obispo (another one of those schools were all the black students are athletes or african exchange students), which is 99.9% white, but it also has a huge Mardi Gra party each year. Some how I managed to have a date with a black guy that night, his cousin also came out with us with his white girlfriend. She got drunk and mad at her boyfriend and was calling him n-word this n-word that.

After we dropped her off at home I said how can you let that white girl talk to you like that?! They just thought it was funny. I don't care how mad I get at my man, and trust me I've gotten pretty mad at him before, I would never call him that.

I've also seen white guys call each other n*gger. What I want to know is, why is this exceptable in California? And not in other parts of the country? Is it because the slaves weren't brought to California? I just don't understand this. My grandmother is american indian and told me that when she was growing up as a child in California, people would call her a prairie n*gger.

Why don't parents teach there kids how hateful this word is?

Now as a white man with two 1/2 black chidren I find the name weird.

Since the expression shows the lack of appreciation for the particular attention given by these women, no matter their colour.

As to say : The cow that made my burger was stupid. But I am still eating it.

Anyone faces similar unromantic situations ?
